The police officer, appointed as responsible for preparing dossiers, with research in the police’s internal systems, on enemies and potential targets of Jamil Name and Jamil Name Filho, those accused of leading a criminal organization investigated in Omertà, presented several appeals to the Court based on the supposed nullity of all the evidence extracted from the “pink pen drive”. The allegation is that police officers from Garras (Department for the Suppression of Gang Robbery, Assaults and Kidnappings) had violated the device, accessing it before asking for judicial authorization to break confidentiality and forwarding it to forensics.

In a July decision, judge Luiz Gonzaga Mendes Marques, rapporteur of the appeals presented to the 2nd instance, had already given a decision showing a similar understanding to that of Gaeco. “Written documents supporting the data that were extracted from said pen drive were seized next to the aforementioned pen drive, which were not challenged by the parties in a timely manner.” The judge also stated that the accusations are not based exclusively on material collected from the pen drive, “but also on other elements assessed by the single court, which are sufficient to maintain the sentence of indictment in relation to the appellant [Everaldo]”.

The crime – Marcel was murdered with a 9 mm pistol shot at close range while drinking with friends in a bar in Campo Grande. The execution took place in the early hours of Thursday, October 18, 2018.

According to the police report, the target was sitting at one of the tables in the commercial establishment, which is close to the sidewalk, when the shooter got off a motorcycle and, without taking off his helmet, shot at least twice in the victim’s back.

The killer arrived and parked behind Marcel’s vehicle. After the crime, he got back on the motorcycle and fled, turning into the first street on the right. The entire action was filmed by the bar’s security cameras.

On October 26, 2018, a week later, businessman Joel Colombo gave a statement at the 1st Police Station, in Campo Grande, and said that his son had a dispute with Jamil Name Filho because of a fight that occurred in a nightclub in the city. years before. He also reported that Marcel even sought out his rival’s father, businessman Jamil Name, to apologize for what happened.

The first request for the arrest of the Names and the rest of the militia, in September last year, brought reports that the fight in the nightclub was never forgotten and had led to the order of death.

José Moreira Freires, “Zezinho”, and Juanil Miranda, the hired killers who killed Matheus Coutinho Xavier, 20, are also named by Omertà as the gunmen responsible for Colombo’s murder, but in the case of “Playboy”, Juanil would be the shooter.

According to the investigative task force, Freires, who has since died, was responsible for shooting the law student. Miranda was never found. Marcelo Rios is accused of placing the order and organizing the execution.
