What is the purpose of the Constitutional Council? Understand in 3 minutes

Asked to examine the law relating to immigration wanted by the government and adopted thanks to the votes of the extreme right, the Constitutional Council pronounces this Thursday, January 25 and could censor several provisions of this extremely controversial text. Of the 86 articles of this law which toughens the conditions for welcoming foreigners on French soil, 44 were called into question in four different referrals. The law could therefore come into force without some of its key measures.

But how exactly does this institution work, which has the power to censor laws passed by the national representation? The primary goal of the Constitutional Council is, as its name indicates, to be the guarantor of respect for the Constitution, the supreme legal norm in France. Concretely, it is responsible for verifying that the laws do not go against the fundamental principles written therein.

But it is rare for wise people to censor, and therefore judge unconstitutional, a law as a whole. Of the 841 laws studied since 1958, only 20 have been completely censored; 376 partially.
