This Tuesday, the Chamber of Deputies approved the recreation of insurance for victims of traffic accidents, previously known as DPVAT. Administered by Caixa Econômica Federal, the new resource will allow the return of mandatory insurance charges for all motor vehicle owners.

The figures will be the responsibility of the state bank in a new fund, which will now be called Mandatory Insurance for the Protection of Traffic Accident Victims (SPVAT). The text, however, still depends on approval in the Senate.

DPVAT is insurance for Personal Injury Caused by Motor Vehicles on Land Roads, designed to compensate victims of traffic accidents. It served drivers, passengers or pedestrians and was paid by all vehicle owners. Its charge was terminated in 2019 by decision of Jair Bolsonaro’s government, alleging that the cost of maintenance and supervision was too high and an alleged high number of frauds occurring in the system.

The coverage of the new insurance, as well as the old one, serves to generate compensation for death, permanent, total or partial disability, and reimbursement of expenses for medical care, funeral services and professional rehabilitation of victims who may have developed partial disability.

The project brings a change: it will allocate between 35% and 40% of the amount collected by the fund to municipalities and states where there is a municipal or metropolitan public transport service.

The compensation amounts will be established by the National Private Insurance Council, after the project is approved by Congress. The fund will be managed by Caixa. Insurance will be paid to everyone who provides proof of the accident and the damage it caused, regardless of whether it was caused intentionally or unintentionally.

According to Caixa, the fund’s current resources were sufficient to guarantee the payment of compensation for accidents that occurred up to November last year. It is not yet known what the payments will be like if the project progresses in the Senate and ends up being sanctioned. According to a fortnightly report sent by the bank to the Superintendency of Private Insurance (Susep), an agency linked to the Ministry of Finance that controls and supervises DPVAT insurance indemnities, from November 15th to December 1st of last year alone there were 1,543 requests from accident victims from all over the world. the country that could not be met.

In theory, the victim who is entitled to reimbursement for Medical and Supplementary Assistance Expenses (DAMS) or compensation for Permanent Disability (IP) must request compensation directly via the DPVAT CAIXA application. Within the Application, you must access “I want to request my DPVAT compensation”, fill in the requested information and, after entering the type of compensation, select the option “I am the victim”, completing the requested flow and attaching the requested files. Another option is to go to one of the bank’s branches with complete documentation, following the deadlines and other guidelines available on the website.

To send documentation, you can take photos of the physical documents through the application or use document files that are already available on the user’s cell phone. Documents must appear on both sides, uncut and legible.
