Adopted on December 19, 2023 in the Senate and the National Assembly thanks to the votes of the right and the far right, the bill relating to immigration must now pass the crucial stage of the Constitutional Council. The government, which nevertheless passed the law, later admitted adoption of the text that certain measures added by the senatorial right could be contrary to fundamental rights.

The President of the Republic, Emmanuel Macron, also specified, during his press conference on January 16 at the Elysee: “The law has been passed, it is submitted to the Constitutional Council, and I will then have to promulgate a text which will be corrected for any possible censorship. »

After Christmas, the members of the Constitutional Council received four lashings concerning this text, much criticized on the left. On December 21, 2023, Mr. Macron signed a “blank” referral, in which he asked the Constitutional Council to examine the text without stating the slightest grievance. The three other referrals – the one formulated by the President of the National Assembly, Yaël Braun-Pivet, the one signed by more than sixty left-wing deputies and the one filed by more than sixty left-wing senators – focus more particularly on arguing about each articles which they believe should be censored due to their unconstitutionality.

The Constitutional Council, which will deliver its decision on January 25, could reject dozens of measures dear to the right and the far right, such as the conditioning of social benefits or the tightening of family reunification.

Of the 86 articles of the law, 44 articles are the subject of complaints in the various referrals. A large number of them are reported as “legislative riders”, that is to say unrelated to the subject of the law initially tabled, and could be censored.
