When it comes to benefits for asylum seekers, financial and legal aspects sometimes come into conflict. The two ministers responsible in the traffic light coalition, Treasurer Christian Lindner and Justice Minister Marco Buschmann, outlined a common line for cuts at the weekend. “A new realpolitik in the area of irregular migration to Germany” must include reducing the incentives for people entering the country illegally, the two FDP ministers wrote in a newspaper article.
“In the past, many debates have been blocked with blanket references to the case law of the Federal Constitutional Court,” they criticize. The legal scope for adjustments is “possibly greater than many people think”. However, this rather cautious formulation points out that it is not so easy to say which political measures to limit illegal migration the Constitutional Court would accept. What is beyond doubt, however, is Karlsruhe’s strict watchdog role in asylum policy.
