“Human dignity cannot be relativized in migration policy.” This sentence from the Federal Constitutional Court has become the guiding principle of critics of a stricter refugee policy. Before the Prime Minister’s meeting with Chancellor Olaf Scholz (SPD) next Monday, around 150 associations called for unrestricted social benefits for asylum seekers as well as those required to leave the country.

The legal scholar Daniel Thym now counters this: “The ban on reducing benefits for migration policy reasons does not mean that everyone always has to receive the same thing,” writes the professor of public law, European and international law at the University of Konstanz. The Basic Law in no way stipulates that no distinctions may be made in social law.
