Illinois sues Trump Governance over Immigration Enforcement Tactics

Illinois Attorney General kwame Raoul announced Monday a lawsuit against the United States Department of Homeland Security and several Trump administration officials, alleging the use of “unlawful and perilous tactics” by immigration enforcement agents. The legal action, filed in the U.S. District Court for the Northern District of Illinois’s Eastern Division, arrives days after a fatal shooting involving an Immigration and Customs Enforcement (ICE) agent in Minnesota.

The lawsuit asserts that the Trump administration initiated “an organized bombardment on the State of Illinois and City of Chicago, causing turmoil and imposing a climate of fear.” The City of Chicago has joined the state as a plaintiff in the case, signaling a unified front against what officials describe as federal overreach.

Among those named as defendants are Department of Homeland Security Secretary Kristi Noem, U.S. Immigration and Customs Enforcement Director Todd Lyons, U.S. Customs and Border Protection Commissioner Rodney Scott, and U.S. Border Patrol Cmdr. Gregory Bovino.

Raoul characterized the federal operation as an “assault on the state’s sovereignty” and a direct violation of the Tenth Amendment and the Administrative Procedure Act.He emphasized that the lawsuit is a critical step in safeguarding the well-being of Illinois residents and protecting the state’s autonomy. According to Raoul, the aggressive tactics have led to disruptions in essential services, including schools going into lockdown, social service organizations curtailing their operations, and increasing hindrances to courthouse proceedings.

“Border Patrol agents and ICE officers have acted as occupiers rather than officers of the law,” Raoul stated Monday.

Did you know?-The Tenth Amendment to the U.S.Constitution reserves powers not delegated to the federal government to the states, or to the people.

Governor JB Pritzker echoed these concerns, asserting that “unchecked federal agents have aggressively assaulted and terrorized our communities and neighborhoods in Illinois, undermining Constitutional rights and threatening public safety.” He continued, “In the face of the trump Administration’s cruelty and intimidation, Illinois is standing up against the attacks on our people. Today, Illinois is once again taking Donald Trump to court to hold his administration accountable for their unlawful tactics, unnecessary escalations, and flagrant abuses of power.”

Pro tip-The administrative Procedure Act (APA) governs the process federal agencies use to create and implement regulations.

The state is seeking a court order to halt specific enforcement tactics deemed to exceed the federal agents’ statutory authority. These include the use of tear gas without warning, the scanning of biometric information of Illinois residents, and entering private property without proper warrants or owner consent. The lawsuit specifically requests that enforcement activities be prohibited in or near sensitive locations like courthouses, schools, and hospitals, allowing exceptions only in “extenuating circumstances and with safeguards.”

Furthermore,Raoul is requesting the court mandate that all vehicles operated by Customs and Border protection (CBP) and ICE display visible, accurately assigned, and properly registered license plates.

Chicago mayor Brandon Johnson affirmed the city’s commitment to protecting its residents’ rights. “The Trump administration has repeatedly violated the law and undermined public trust,” Johnson said in a statement. “These actions weren’t just unlawful; they were cruel, needlessly inflicting fear and harm on our communities. My administration will forcefully protect our residents’ rights and hold anyone accountable who abuses their power. Nobody is above the law. This lawsuit is about ensuring there is accountability for the lawless actions of the Trump administration and justice for the Chicagoans who have been wronged.”
