The review of the judicial reform raised by the majority of ministers of the courtwill allow us to evaluate whether the judicial independence and democracy of the country are violated, estimated the Employers’ Confederation of the Mexican Republic (Coparmex).
“We express our support for the Supreme Court of Justice of the Nation (SCJN) in the historic review of the reform”, stating that this review highlights the importance of having a Judiciary autonomous in the face of political and economic pressures.
Coparmex pointed out that the intervention of the ministers to analyze the challenge of the judges and magistrates, demonstrates the Court’s commitment to the rigorous analysis of this measure.
He said that it is important to highlight that, with this resolution, the SCJN is not prejudging the substance of the controversy, but is guaranteeing an adequate process in which the procedural guarantees of the parties involved.
“The SCJN has not only the power, but the responsibility to review the constitutionality of any reform that affects the balance between powers, including those that may compromise the autonomy of the Judiciary”, he added.
The business body insisted that the review of this reform establishes a fundamental precedent for future modifications who try to alter the institutional structures of the country.
“We reaffirm the need for rigorous judicial control over any amendment that intend to modify the bases ofl Rule of Law that we have built as a society, ensuring that the laws do not weaken the democratic system.”
He stated that the review is not only a technical procedure, but a crucial opportunity to protect the institutions that safeguard justice in Mexico, having at Constitution like him indispensable reference.
“The possible suspension of the reform, If this is decided, it would be a firm step in the defense of judicial independence, an indispensable pillar for democracy.”
