The requisitions and pleadings in the case of the former Minister of Defense, Dr Mohamed Diané took place this Wednesday. This, in the absence of his lawyers since he decided not to speak before the CRIEF on the grounds that his rights are not respected.
He was prosecuted for misappropriation of public funds, illicit enrichment and money laundering.
In the pleadings, the lawyers of the civil party regretted the fact that the defendant chose not to respond to the court to defend himself against the facts put against him while at the preliminary investigation and before the investigating judge , he had spoken of his possessions.
During his pleadings, one of the State’s lawyers, Me Antoine Pépé Lama, declared in particular: “ Dr Diané made a deal worth 11 billion Guinean francs here in complete violation of procedure. He provided the Djoma company with the contract for 28 double-cabin pick-ups at a cost of 11 billion Guinean francs, which he made available to the Special Forces Group. Also, a gap of 500 billion Guinean francs was detected between the budget allocated to the Ministry of Defense and the expenditure made. Asked about this gap, Dr Mohamed Diané spoke of defense secrecy, he could not justify himself. It is proven that he owns 30 built and undeveloped estates in Kankan and Conakry. And, he is unable to justify the origin of his assets. This is why, Mr. President, we ask you to order the confiscation of all the property of Dr. Diané placed in his name and in the names of third parties for the benefit of the State. And, to possibly order the provisional execution of the decision to be taken. And, as damages, we are asking for a sum of 500 billion Guinean francs.”
Still, for the civil party, Dr Mohamed Diané who was a professor of Biology and walked on foot until 2011 did not have income which allowed him to have five bank accounts including foreign currency accounts, buildings, hotels, villas, houses, modern farms, luxury cars, plantations, tractors, around thirty estates in Conakry and Kankan, service stations, excuse me the list is long.
For the civil party, Dr Mohamed Diané betrayed to serve himself and not to serve the state.
The prosecution, which did not hold back, speaks of the bad faith of the defendant who provided the list of some of his assets without saying how he obtained his assets. While remaining silent.
The prosecution emphasizes that Dr. Diané admitted to having received the money but refuses to talk about the use made of the Guinean taxpayer’s money.
In view of the above, the special prosecution requires that Dr Mohamed Diané be held guilty and sentenced to five years in prison. But also, the emperor of the prosecution of the crief asks that it pleases the court to confiscate the property of Mohamed Diané in the profile of the State which he betrayed.
The special prosecution agreed with the civil party by requesting five years in prison against Dr Diané.
A defendant who remained straight in his boots in his last words: “mHis rights have been violated. I did not receive a fair trial. So, I continue to exercise my right to remain silent.”.
It is with these words that Judge Yacouba Conté postponed the case until December 18 for a decision to be rendered.
