The roof for subcontracting
The law sets the ceiling for subcontracting at 40% but it was decided to make it modular to keep together the requests of the unions and the desire of Palazzo Chigi to overcome the regulatory limits, as required by the EU, while preserving the maximum protection of labor and legality. The decree prohibits the entrusting “to third parties” of the “full execution of the services or works covered by the contract” and “the prevalent execution of labor-intensive contracts”. The subcontractor is required to have “the same quality and performance standards provided for in the contract” and to workers the recognition of an “economic and regulatory treatment not lower than that which the main contractor would have guaranteed”. In the event that the two companies carry out the same activity, it can be said that the same national collective labor agreement must be applied.
Women and young people
It will be a “necessary requirement” for companies taking part in the Recovery plan tenders to be obliged to take on a quota, not less than 30%, of young people under 36 and women.
