The conflict of neighbors on Nefedova Street led to litigation and inspections. Where there used to be a modest one-story house, a large-scale construction project unfolded, while the neighboring house cracked and became uninhabitable. The authorities say that the new building violates town-planning regulations and intend to file a claim for demolition.

Vera Zaitseva, the owner of the injured house 74 on Nefedova Street, has been seeking justice since 2018. Then construction began on the neighboring site, the workers demolished the retaining wall, dug a foundation pit. A three-story new building has sprung up almost right next to her house.

“The wall adjacent to the construction site at 72, Nefedova, is all rotten, the ceiling has collapsed in the room, cracks have gone through the house,” Vera Grigorievna says. – The examination, which I did, showed that the house has become dangerous for living. A pit was dug, our retaining wall with a buttress was demolished, the fence was completely demolished, the cherry tree was piled on the roof of the house, during the rain it flowed from all the cracks.

The houses stand on a steep slope. They were built in the post-war years. The slope was reinforced with retaining walls, without which everything slides down. Vera Zaitseva’s house was built by her father – a participant in the defense of Sevastopol. She has lived in this house all her life, over 60 years. She says that she never had any problems with her neighbor, they lived together. But a few years ago, a neighbor died, the house was inherited by her daughter, and she started a construction project. It was not possible to agree peacefully with the new owner, so Vera Zaitseva went to court with a demand to stop the construction.

“They had a small house, and next to it was a farm building,” the woman says. – In court, they argued that they were not building a new house, but were doing reconstruction. At the trial, the expert stood and lied that there was no foundation pit on the site, although I have photographs of the foundation pit, we called the police when it was poured with concrete. But the court refused a second examination.

The neighbors filed a counterclaim against Zaitseva – they demanded to demolish her house on the grounds that he was allegedly encroaching on the territory of their site. The court dismissed both claims. Recently, no one has lived in the Zaitsevs’ house. The family planned to put it in order, to repair it. Now they don’t know what to do.

Vera Zaitseva was supported by the Committee on Urban Planning and Land Issues of the Legislative Assembly of Sevastopol, and the relevant departments of the city government were involved.

As it turned out, on a plot of less than three acres, two three-story houses are being built at once, located very close to each other. According to preliminary data, the object has signs of a multi-apartment building. But this is not the only violation.

According to the deputy director of the department of architecture and urban planning of Sevastopol Mikhail Naumov, the landlord of the site applied for the reconstruction of the old house, but she was refused.

– The owner of the site was refused due to violation of indents from neighboring land plots and red lines, – said Naumov. – She did not have any documents, they did not give her the go-ahead.

The representative of Sevgosstroynadzor said that the owner of the site did not make contact and did not want to let the inspectors into the territory. But Sevgosstroynadzor, together with the employees of the department of municipal services, nevertheless carried out an inspection and found violations. Officials are in no hurry to announce them yet. To begin with, the question will be submitted to a meeting of the commission to suppress unauthorized construction. Next, a demolition lawsuit will be filed. …

– I hope that a decision will be made on the demolition of this building, there is a bunch of violations that have been recorded by the departments of public security and municipal services. The distance to the neighboring house and the indent from the “red lines”, which should be three meters, have been violated. They are building like two houses, there is a small gap between them. It can be assumed that the building has signs of multi-apartment.
