Indonesian Officials Receive Presidential Rehabilitation in Corruption Case

jakarta, Indonesia – Former executives of PT ASDP, a state-owned ferry operator, have been granted rehabilitation by President Prabowo Subianto following a high-profile corruption case involving alleged financial losses of IDR 1.25 trillion (approximately $78 million USD). The move, delivered on Tuesday, November 25th, aims to restore the reputations of those involved after a contentious legal battle.

The recipients of the presidential rehabilitation include Ira Puspadewi, former President Director of PT ASDP, alongside Muhammad Yusuf Hadi, Director of Commercial and Services, and Harry Muhammad Adhi Caksono, Director of Planning and Progress. the case centered around allegations of corruption related to a Business Cooperation (KSU) agreement and the 2019-2022 acquisition of PT Jembatan Nusantara (JN) by PT ASDP.

the rehabilitation was formally presented by Deputy Chairman of the Indonesian House of Representatives, Sufmi Ahmad Dasco, at the Presidential Palace. “I would like to express my highest gratitude and gratitude to president Prabowo, as well as Bang Dasco, Bang Teddy and the Minister of State secretary for providing rehabilitation to my client,” stated Soesilo Aribowo, attorney for Ira Puspadewi. “This means that there is a return to the rights of ordinary humans, as free humans because there were errors in the process, regarding the law.”

Aribowo indicated plans to immediately seek the release of his client from the KPK (Corruption Eradication Commission) upon confirmation of the president’s letter of rehabilitation.

As of this publication, the KPK has not issued an official statement regarding President subianto’s decision.

Previously, the Jakarta Corruption Court sentenced Ira Puspadewi to 4 years and 6 months imprisonment, along with a fine of Rp. 500 million (approximately $31,000 USD). Yusuf Hadi and adhi Caksono each received 4-year sentences and fines of IDR 250 million (approximately $15,500 USD). The court found the defendants guilty of corruption that resulted in substantial state financial losses.

He suggested that the matter would be more appropriately addressed through civil proceedings, citing the protection afforded by Business Judgement Rule (BJR) principles.

Legal frameworks governing rehabilitation are outlined in Article 1 Number 23 of the Criminal Procedure Code, which defines rehabilitation as the restoration of a person’s abilities, position, honor, and dignity following an unjust arrest, detention, prosecution, or trial. Article 97 paragraph (1) of the old KUHAP further stipulates the right to rehabilitation upon acquittal or dismissal of all legal demands with a permanent legal force.
