Kozhikode: The Jamaat-e-Islami and the KNM are questioning the fundamental values of the Karnataka High Court constitution which upheld the ban on hijab in educational institutions.

Jamaat-e-Islami Kerala Ameer MI Abdul Aziz has said that the Karnataka High Court’s ruling approving the government’s ban on hijab in educational institutions in Karnataka calls into question the very foundations of the Constitution. The court ruling is highly controversial. The court decision is a denial of the fundamental rights guaranteed by the Constitution.

The court upheld the fundamental right and freedom of religion by upholding the government’s position that the hijab was not an obligatory practice in Islam. The courts must ensure the protection of the citizen when the state encroaches on the rights of the citizen. Abdul Aziz said such verdicts would destabilize the people’s faith in the judiciary and seriously affect the future of the country. He also reminded that civil society needs to work for the democratic and pluralistic values of the country.

KNM state president TP Abdullakoya Madani said the Karnataka High Court’s ruling upholding the ban on hijab on Karnataka campuses was “unfortunate” as the court had lost sight of the fundamental right of girls to wear Islamic clothing.

In a country where clothing diversity exists, it should be reconsidered whether it is fair to restrict the right of Muslim girls to dress as they wish. The fact that people are once again taking to the streets in the name of hijab will tarnish the image of the country. Madani said the ban on fundamental rights was an expression of intolerance in the country
