The Consumer Protection Commission (CPC), as a state body, has the duty and authority by law to terminate violations of consumer protection regulations. This is stated in her position by the chairperson of the KZP, Maria Filipova, in response to the insistence of the Sofia Bar Council to explain its call for users of so-called fast loans to file complaints with the Commission if there are violations in their contracts.
“The legal profession has a different scope of activity – it can assist in the removal of damages and the restoration of the legal situation, but it does not have the authority to stop violations or exercise control over violators. In my initial statement, I quite clearly refer to the provision of Art. 178, paragraph 1 of the Law on Consumer Protection, which regulates the duties and powers of the Commission. and the legal profession. Appeals to citizens not to report violations of the law to the authorized bodies are not only in violation of the legislation, but also undermine the foundations of our democratic society,” Filipova’s position reads.
“In relation to the recent publications and comments on the activities of the KZP, I confirm that all my actions are guided by the mission to protect the interests of consumers and ensure compliance with the legislation. The KZP welcomes constructive dialogue and the support of associations in the sector, while remaining independent an institution that works in accordance with its powers. I, as the chairman of the Commission, firmly stand behind my position of transparent and responsible behavior in the protection of the rights of consumers rights, are not only unfounded, but also call into question the protection of the public interest. Such calls would be tantamount to encouraging citizens not to report violations of the law to the authorities that the state has authorized to stop them,” says Filipova.
At a press conference two days ago, Filipova announced that she had issued an order according to which non-bank financial institutions have 14 days to review contracts with their clients for unfair clauses. Otherwise, she announced that she would file a class action in court and called on injured consumers to file complaints with the CPC.

Maria Filipova: Certainly. The Sofia Bar Council encouraged users of fast loans to file complaints about potential violations directly with legal professionals instead of authorized bodies like ours. I believe this is problematic. While the legal profession can provide assistance in resolving individual disputes, they do not have the authority to stop systemic violations or oversee compliance. It’s crucial for consumers to report their concerns to the CPC, so we can take appropriate action.

Maria Filipova: I would advise them to consider the implications of not reporting violations. We need to work together to uphold consumer rights and ensure that violators are held accountable. Our commission is equipped to handle these issues and can act decisively when given the information.
