KZP can and should terminate the violations of the normative acts

by times news cr

The Consumer Protection Commission (CPC), as a state body,‍ has the duty and authority by law to terminate⁣ violations⁣ of consumer protection ‌regulations. This is stated in her position‍ by the chairperson of the⁢ KZP, Maria Filipova, in response to the insistence of the Sofia ⁣Bar Council⁣ to explain its call for users of so-called fast loans⁤ to file complaints with⁣ the Commission ‌if ⁤there are violations in their contracts.

“The legal profession has a ⁣different scope of activity – it‌ can assist in the removal of damages and the restoration of the legal situation, but it does‍ not have the authority to stop ⁣violations or exercise⁤ control over ⁣violators.‍ In my initial statement, ⁣I quite clearly refer to the provision of Art. 178, paragraph 1 of the Law on Consumer⁢ Protection, which regulates the duties and powers of the Commission. and the legal profession. Appeals to ⁣citizens not to report violations of the law to the ⁤authorized bodies are not only in violation of the legislation,‍ but also undermine the foundations‍ of our democratic society,” Filipova’s position reads.

“In relation to the⁢ recent publications and comments on‌ the activities of the KZP, I ⁣confirm that all my actions are guided by the mission to protect the‌ interests of consumers⁢ and ensure compliance with the legislation. The KZP welcomes constructive dialogue and the support of associations in the sector, while ‍remaining independent ⁤an institution that works in accordance with its powers. I, as the chairman of the Commission, firmly stand behind my position of transparent‌ and responsible behavior in the protection of the rights of ⁣consumers rights, are ⁤not only unfounded, ⁤but also call into question the protection of the public interest. Such calls would be tantamount to encouraging citizens not to report violations of ⁣the law to the authorities that the state has authorized to stop them,” says Filipova.

At a press conference two days ago, Filipova announced that she had‌ issued an order according to which⁣ non-bank financial institutions have 14 days to review contracts with their clients for unfair clauses. Otherwise, she announced that she would file a class action in court and ⁤called on injured consumers to file complaints with ‍the CPC.

The Association for Responsible Non-Bank Lending (AONK) announced that they welcome the activity of KZP and ‌its president⁣ Maria Filipova⁣ regarding the actions to end⁤ the illegal practices of companies ‍for the granting of quick loans,⁢ writes ⁢BTA.

Interview Between Time.news Editor and Maria Filipova, Chairperson of the Consumer Protection⁢ Commission

Time.news Editor: Welcome, Maria Filipova, it’s a pleasure ‍to‌ have you with us today. The topic of consumer protection is incredibly important, especially in today’s economic climate. To start off, could you explain the key role of the Consumer Protection Commission⁢ in addressing violations of consumer rights?

Maria Filipova: Thank you for ⁤having ‌me. The Consumer Protection Commission (CPC) is a state body mandated by law to ensure the enforcement of consumer rights. Our ‌primary responsibility⁢ is to terminate any violations of consumer protection regulations. We act as a ⁤guardian for consumers, ensuring that ‌their rights are respected,‍ and that they can report any grievances they encounter, particularly concerning practices ⁤like fast loans.

Time.news Editor: Speaking of fast loans, there has⁣ been some contention recently between the CPC⁣ and the Sofia Bar Council regarding the reporting of violations. Can you share your thoughts on this?

Maria ‌Filipova: Certainly. The Sofia Bar Council ⁤encouraged users ⁢of fast loans to ⁤file complaints about potential violations directly‌ with legal professionals instead of authorized bodies like ours. I believe this is‌ problematic. While the legal profession can provide assistance in ⁢resolving individual disputes, they do not ‌have the authority to stop systemic violations ⁢or oversee compliance. It’s crucial for consumers to report their concerns to the CPC, so we can take appropriate action.

Time.news Editor: That’s an interesting point. So, what would you say ⁢to consumers who might be hesitant to report violations ⁤to the CPC due to the advice from ⁢legal professionals?

Maria⁣ Filipova: I would⁢ advise them to consider the implications of not ‌reporting violations. When consumers are ‌discouraged from reaching out to the CPC, it undermines our legal framework and, ultimately, our democracy. We need to work together to uphold consumer rights and ensure that violators are held accountable. Our commission is equipped to handle these issues‍ and ⁢can act decisively when given the information.

Time.news‍ Editor: You mentioned the importance of collaboration between citizens and ⁢the CPC. How can consumers effectively communicate their issues to your commission?

Maria‍ Filipova: Consumers can report violations through our website, where we have‌ specific forms to fill out, detailing their complaints. Additionally,⁤ we encourage ⁣them to provide any supporting documents that may aid ⁢our investigation. We take every complaint seriously, and ‍it’s through these reports that we can identify trends and take enforcement actions against violators.

Time.news Editor: Looking forward, how do you foresee the role of the ‍CPC‌ evolving with the rapidly changing landscape of consumer rights and technology?

Maria Filipova: As technology evolves, so do the tactics employed by those⁢ who may infringe on⁤ consumer rights.⁢ The CPC must remain agile ‍and informed about new practices, especially in ⁢areas like online lending. We are also exploring greater⁣ public awareness campaigns to educate‌ consumers about their rights and how to navigate⁣ the digital marketplace safely.

Time.news Editor: That sounds promising,⁢ Maria. Before we‌ wrap up, what final message would⁤ you like to convey to consumers and legal professionals alike regarding consumer protection?

Maria Filipova: My message is simple: consumer protection is a shared responsibility. I urge both consumers and legal professionals to ‌recognize the vital role that the CPC⁤ plays. Let’s work‌ together to strengthen consumer rights and ensure that our ⁤marketplace is fair and transparent. Reporting violations is a step towards a more just system for everyone.

Time.news Editor: Thank you so much, Maria, for your insights and for spotlighting ⁤the⁤ importance of consumer ‌protection. We⁢ appreciate your time and dedication to this vital issue.

Maria Filipova: Thank you for having me. It’s been a pleasure⁣ to discuss⁣ this important topic.
