Lamborghini Crash in Kanpur: Son of Tobacco Baron Released on Bail Amid Procedural Concerns
A district court in Kanpur, Uttar Pradesh, granted bail to Shivam Mishra, son of prominent tobacco businessman KK Mishra, on Thursday, February 15, after rejecting a police request for further remand in connection with a high-speed Lamborghini crash that injured six people on February 8. The court cited significant procedural lapses in the arrest, raising questions about the investigation’s handling.
Bail Granted, Police Procedures Questioned
The court’s decision to release Mishra on a Rs 20,000 personal bond stemmed from concerns over the legality of his arrest. Court documents revealed the arrest was made without proper notice under the BNSS and in violation of guidelines established by the Supreme Court in the Arnesh Kumar judgment. This ruling underscores the importance of adhering to due process, even in high-profile cases.
Allegations of Political Interference
Mishra’s legal counsel, Naresh Chandra Tripathi, vehemently contested the arrest, alleging it was unjustified and influenced by external pressures. “The Court has refused the remand,” Tripathi stated to reporters. “He is being released now, on an undertaking of Rs 20,000 and a personal bond of Rs 20,000. The police were working under pressure from the government. Police had wrongly arrested him.” These claims raise serious questions about the impartiality of the investigation.
The Incident and Conflicting Accounts
The incident occurred near Jhula Park Crossing in Kanpur on the afternoon of February 8, when a Lamborghini allegedly struck an autorickshaw, a motorcycle, and a pole, resulting in injuries to six individuals. Eyewitnesses reported the vehicle was traveling at a dangerous speed. Initial reports were clouded by conflicting accounts regarding who was driving the vehicle at the time of the crash.
Mishra initially claimed his driver, Mohan, was operating the Lamborghini when the accident occurred, a statement contradicted by eyewitness testimony and CCTV footage.
Driver Accepts Responsibility, Claims Seizure
In a surprising turn of events, Mishra’s driver, Mohan, came forward on Wednesday and admitted to being behind the wheel. He stated that Mishra was seated beside him when he experienced a seizure, causing him to lose control of the vehicle. “Yes. He had a seizure,” Mohan explained. “Suddenly, his arms and legs started shaking, and he fell on me. I was there at the spot. I was there on the day the accident happened. The bouncer pulled me out of the car.” Mishra’s lawyer confirmed that Mohan submitted an affidavit accepting full responsibility for the accident.
Ongoing Investigation and Public Scrutiny
The case has drawn significant public attention, fueled by the wealth and connections of the involved parties. The conflicting narratives and allegations of external influence have further intensified scrutiny. Authorities are expected to continue their investigation to determine the precise circumstances surrounding the crash and ensure accountability.
