PRI presents before Court, unconstitutionality action against judicial reform

Considering that there are defects in the legislative procedure, the Institutional Revolutionary Party (PRI)presented before the Supreme Court of Justice of the Nation (SCJN), a unconstitutionality action against the judicial reform published in the Official Gazette of the Federation on September 15.

He described that among the arguments presented before the Court highlight the irregularities in the legislative process to approve the reform, “among them the violation of two suspensions, at that time; the lack of public deliberation of the reforming power and the lack of ruling and discussion of the Law in the federal entities.”

He said that, from the beginning of the discussion in the Chamber of Deputiesthere was no legal quorum to meet.

Another of the arguments presented before the SCJN is the violation of the principle of political representation“the lack of political deliberation and analysis of the Law violates the principle of representation.”

He pointed out that another violated principle is that of division of powers. “The reform subordinates the Judiciary to other powers, which dismantles the guiding axes of the Rule of Law in Mexico,” as well as the violation of the right to access to justice since, by replacing all ministers, magistrates and judges, open procedures and those that are about to begin, among others, are hindered.
