The Progressive Union of Prosecutors (UPF) and Judges for Democracy (JJpD) have once again demanded the resignation en bloc of the members of the General Council of the Judiciary (CGPJ) when five years have passed since the mandate expired due to the blockade of the PP. “With their actions they have contributed to the discredit of an institution that we see is in clear decomposition,” they lament.

The acting Judiciary charges against the “poor management” of the attorney general to reject his appointment

At the moment, the only members of the body who have taken this step have been former president Carlos Lesmes, who resigned in October 2022, and the progressive member Concepción Sáez, who resigned last March. The resignation of the latter encouraged an attempt to resign by the members of the minority progressive sector that finally came to nothing.

The governing body of the judges reaches five years with its mandate expired and with a conservative majority increasingly entrenched as a counterpower to the Government in a strategy launched by José María Aznar, between 1995 and 1996; Mariano Rajoy followed her, between 2006 and 2008; and first Pablo Casado and then Alberto Núñez Feijóo have made the most of it. Thanks to this succession of blockades, the PP has guaranteed conservative dominance in the body that decides the main promotions in the judicial career in 22 of the last 27 years.

In a joint statement, both associations criticize that the members “contribute” to maintaining a situation that violates the Constitution and the Organic Law of the Judiciary despite the fact that, due to their “profession and responsibility”, they are obliged “to guarantee compliance with both and the legal system.” “They extend their mandate without credibility, without legitimacy and without any shame,” they say.

“We must remember that a majority group of members of the CGPJ allows itself to intervene in the partisan debate on a bill that had not even been presented in the Cortes. [en alusión a la amnistía]; delay the mandatory report on bills (…); give an opinion with his expired and acting position on the suitability of the State Attorney General, and deliberately delay the renewal of the Constitutional Court for weeks,” both organizations add.
