The prosecution, which has been investigating suspicions of the illegal declaration of martial law on December 3, is transferring the case of President Yoon Seok-yeol and former Minister of the Interior and Safety Lee Sang-min on charges of rebellion to the High-ranking Public Officials Crime Investigation Office (Corruption Investigation Office).
The Supreme Prosecutors’ Office announced in a press notice on the 18th, “As a result of discussions regarding the case transfer request from the Corruption Investigation Office, including measures to prevent duplicate investigations, we decided to transfer the case against President Yoon and former Minister Lee to the Corruption Investigation Office.” The Corruption Investigation Office decided to withdraw its transfer request for the remaining suspects except President Yoon and former Minister Lee.
The Mutual Aid Investigation Headquarters (Cooperation Investigation Headquarters), which is comprised of the Emergency Martial Law Special Investigation Team of the National Investigation Headquarters of the National Police Agency, the Airborne Corruption Investigation Office, and the Ministry of Defense Investigation Headquarters, also confirmed the transfer by the prosecution on this day and said, “We plan to conduct a strict investigation to the end in accordance with the law and principles under a joint system.” .
The emergency martial law case was investigated by three agencies, including the Prosecutor’s Office’s Special Investigation Headquarters, the National Police’s Special Investigation Team, and the Corruption Investigation Office. As concerns over overlapping investigations grew as each investigative agency carried out the investigation as if competing, the Corruption Investigation Office requested that the case be transferred to the prosecution and police. In order to allay concerns, the Corruption Investigation Agency established a cooperation report with the police and the Ministry of Defense investigation headquarters.
The police partially accepted the request of the Corruption Investigation Office ahead of the prosecution and raised suspicions that President Yoon, former Minister Lee, former Minister of National Defense Kim Yong-hyun, Army Chief of Staff Park An-soo (former martial law commander), ROK Armed Forces Counterintelligence Commander Yeo Yeo-hyung, and Intelligence Command Commander Moon Sang-ho were involved in emergency martial law. The details of the investigation into high-ranking officials were handed over to the Corruption Investigation Office.
