Scope of the Labor reform

During the final session of the second debate, the House reviewed more than 100 propositions to modify and add new articles. Of these, only eight were approved, while the rest were discarded.

These are the most notable points that managed to advance, which according to the Ministry of Labor, seeks to improve working conditions and extend certain benefits.

Main points approved:

Extension of paternity leave: The leave for parents will be extended to four weeks, a measure that seeks to promote co-responsibility in caring for children.

Support for victims of armed conflict: Labor agreements were approved aimed at offering employment opportunities for those who have been victims of the armed conflict in Colombia.

Changes to learning contracts: Students of the National Learning Service (Sena) will continue to benefit from learning contracts, facilitating their transition to the labor market.

Remuneration for days of mandatory rest: Starting in 2025, workers will receive 100% of their salary on mandatory rest days, in a staggered manner: 80% in 2025, 90% in 2026 and full in 2027.

Modification of the daytime work day: Daytime working hours were extended until 7:00 pm. From that time on, the hours worked will be considered as extra night hours.

Leave for marital union or marriage: Workers who declare their de facto marital union or marriage will receive paid leave of three business days, regardless of the type of their contract.

Sustainable labor practices and animal welfare: Companies will be required to implement sustainable labor policies, in addition to allowing pets and companion animals into the workplace as part of their well-being policies.

Job access for young people and formalization of PAE workers: program to facilitate the entry and permanence in the labor market of young people who have recently graduated from higher education. The employment of those who handle food in the School Feeding Program (PAE) will also be formalized.

Social security for digital application deliverers: Social security affiliation will be guaranteed for workers who provide services through delivery platforms.

Leaves to fulfill family obligations: Paid leave will be granted to workers with children who need to attend medical appointments, whether scheduled or urgent.

Fixed-term contracts with a duration limit: Fixed-term contracts may be concluded for a maximum of four years. If these conditions are not met, it will be understood that the contract is for an indefinite term from the beginning.

Flexible hours for workers with caring responsibilities: It was agreed that workers with family care responsibilities, such as children, people with disabilities or older adults, will be able to negotiate flexible hours or work arrangements.

What’s next for the reform:

The bill will now be moved to the Senate of the Republic, where it must be submitted to two other debates, one in the Seventh Commission and another in the plenary. If approved, the Labor Reform will introduce significant changes that will impact thousands of workers in Colombia.
