NEW DELHI-A case has been filed in the Supreme Court claiming that ‘Shariat’ law discriminates against Muslim women in dividing parental property.

In a petition filed by a woman named Pushara Ali in the Supreme Court, it is stated that:

Islamic personal law, known as Shariat, discriminates against women when it comes to division of ancestral and parental property.

According to Section 2 of Sharia Law, when my ancestral property is partitioned, I get only half of my brother’s property. I don’t get a fair share like my brother does.

This is in violation of Article 15 of the Constitution, which states that ‘no discrimination shall be made on the basis of religion, race, sex or place of birth’. I should inquire about this and take steps to get my rightful share in the property.

This was stated in the petition.

A bench comprising Justices Krishna Murari and Sanjay Karol, which considered the matter, ordered a ‘notice’ to be sent to the Muslim Personal Law Board to respond to this petition.
