The Attorney General’s Office has asked the Supreme Court of Justice of Colombia to give the green light to the extradition of Dayonis Junior Orozco CastilloColombian-Venezuelan citizen, required by the government of Chile.
Orozco Castillo is accused of having participated in the murder of a Carabineros Police officerduring an incident that occurred on April 10 in Santiago, the Chilean capital.
In a concept sent to the Supreme Court, the First Prosecutor delegated for Criminal Cassation stated that the documentation presented by the Chilean authorities complies with the formal requirements established by both Colombian legislation and the extradition treaty in force between both countries. Likewise, he confirmed that the documents demonstrated the identity of the person requested, which ensures that the person prosecuted in Chile is the same person who is currently detained in Colombia.

Double criminality principle
The deputy prosecutor pointed out that the case respects the principle of double criminality, since the facts for which Orozco Castillo is requested in Chile have their equivalent in Colombian legislation, specifically in articles 103 and 104 of the Penal Code (Law 599 of 2000 ), which classify aggravated homicide, as well as in article 365, which regulates crimes related to the manufacture, trafficking, carrying or possession of firearms and ammunition.
Likewise, he highlighted that the charges against Orozco are not linked to political crimes, neither in Chile nor in Colombia, which allows compliance with the extradition treaty signed between both countries.
The delegate also specified that, if the extradition is approved by the Supreme Court of Justice, the Chilean government must be warned that Orozco Castillo cannot be tried for facts other than those that gave rise to the extradition request. In addition, it must be ensured that he is not imposed a capital or life sentence, and that he can maintain regular contact with his family. The time that he has been deprived of liberty in Colombia must also be taken into account as part of his eventual sentence.
