The Court agrees with Cofece on the CRE

The Second Chamber of the Supreme Court of Justice of the Nation (SCJN) agreed with the Federal Economic Competition Commission (Cofece) about what this dependency is and not the CREwhich can regulate alliances and mergers hydrocarbon companies.

After a constitutional controversy presented by the Energy Regulatory Commission in 2021, where he argued that his faculties were invaded, the ruling was adverse to him considering that it is the Coffee who should regulate the issue.

“As for the substance, I do not agree with the project proposal because it is based on what was resolved in the constitutional controversy 55/2021 of the First Chamber, in which the coordinated mechanism provided for in article 83 of the Hydrocarbon Law. “This resolution is not mandatory for this Chamber,” said the minister. Lenia Batres who was in favor of CRE.
He stated that it should be understood as a requirement of procedure for the Energy Regulatory Commission to authorize cross-shareholding.
