2. Respond to Subprefecture requests that have remained pending in the Electronic System and have been pending for more than 90 days, within a maximum period of 30 days, under penalty of a fine of R$ 1,000 per tree, per day. 3. Comply with emergency requests within 10 days, even with a daily fine of R$1,000 per expired tree.
4. Update the Telematic System, within five days, with the revisions of the Annual Planning with those carried out at the request of the Subprefectures, with a fine of 100 thousand reals and 10 thousand reals for each subsequent month of delay.
Adjustments to the emergency plan
Furthermore, the Court requested adjustments to Enel’s Contingency Plan, which must be presented within 10 days, under penalty of a fine of R$500,000. Adjustments include:
– Creation of specific operational strategies for the city, considering the presence of over 650 thousand trees and adaptation to intense storms in the period between September and March
– Guarantee of sufficient personnel to restore the electricity supply, wiring and equipment, in less than 24 hours, after the fall of trees or branches, in order to guarantee maximum continuity of service;
– Carry out semi-annual simulations to deal with severe meteorological events.
– Detail of the personnel needed according to the time of year and term of availability, in order to maintain energy supply, including a forecast of increase in qualified personnel during the rainy season;
– Share with the Municipality the georeferenced positioning (GPS) of the vehicles transporting the teams involved in the emergency room.
The decision also establishes that the Enel and city hall work together on tree management, as well as requiring a program to meet requests.
Enel was sentenced to compensate for the collective environmental damage resulting from the failure to manage urban trees and transmission lines, for an amount to be defined during the trial.
“I reiterate the 10-day deadline for the Municipality to present the evidence it intends to produce,” writes the judge in the document.
