With the legislative initiative of the government, an attempt is made to settle a number of problems in the RA Subsoil Code, including the legal relations related to the transfer of the subsoil use right and the extension of the subsoil use right due to the occurrence of force majeure.

Fires, floods, earthquakes, storms or other natural disasters, as well as explosions, war, terrorism, civil war, mass civil disobedience, which the subsoil user could not foresee, prevent and as a result of which the subsoil user did not fulfill or improperly fulfill the obligations are considered force majeure. : RA Deputy Minister of Territorial Administration and Infrastructure Hovhannes Harutyunyan noted this.

In the event of force majeure, the terms of the right are extended by the maximum period of validity of those circumstances, which will enable the companies to properly fulfill the obligations that were not fulfilled? in the unpredictable and extraordinary conditions created in the world and in RA in recent years.

In relation to this provision, the deputy minister noted that it will ensure the predictability of organizing activities for investors, as well as increase investment attractiveness.

According to the draft law, companies are recommended to submit an application to an authorized body regarding the transfer of subsoil use rights, which will clarify all issues related to the transfer.

The legal relations related to the materials submitted for the endological examination will also be regulated. The procedure, forms and guidelines for filling out the annual report on the movement of mineral reserves will be fixed, as well as the definitions of the concept of “predicted mineral resources” will be given more professionally.

In response to the question of Babken Tunyan, deputy chairman of the commission, Hovhannes Harutyunyan noted that the issues were discussed in advance with the representatives of the organizations interested in the field, who responded positively.

During the discussion, committee members Tsovinar Vardanyan and Mkhitar Zakaryan presented recommendations, which were considered acceptable by the main reporter. The first proposal referred to the extension of the right period in case of force majeure, and the second one? to the change of their status during the use of border lands.
