The Supreme Court of Justice of the Nation (SCJN) admitted a constitutional controversy against the judicial reform by the Government of Guanajuato.
The matter was promoted one day after Libya Dennise Muñoz was sworn in as governor of that entity and today it was published in the courts of the constitutional court.
“Prepare and register the physical and electronic file related to the constitutional controversy asserted by whoever claims to be the head of the Executive Branch of Guanajuato, against the Congress of the Union and the local legislatures that approved the claimed norm,” the agreement indicates.
The controversy was turned over to Minister Juan Luis Alcántara Carrancá to decide whether to admit it or reject it and, if applicable, a draft sentence will be prepared and a suspension of the effects of the reform could be issued.
However, the constitutional controversy only applies to the publication of general laws and not against changes to the Constitution, according to Supreme Court precedents.
In turn, this Monday the Plenary Session of the constitutional court will continue with the discussion of the pending consultations against the judicial reform, derived from the request of the country’s judges.
