The Constitutional Court must consider how long the term of office of the new chief prosecutor should be. Arguments are more about finishing, not entirely new. This is what former Minister of Justice Anton Stankov told Nova News. He commented on the nomination of Borislav Sarafov, who currently serves as prosecutor number 1, after in June of this year Ivan Geshev was removed from his post.
Sarafov is the only candidate. It is an unwritten tradition that ministers of justice do not make proposals for high posts in the judicial system, because it would be perceived as interference by the executive branch. I think that the Acting Minister of Justice – Maria Pavlova quite deliberately refrained from running for the post of Prosecutor General. I respect her opinion, Stankov added.
“Was it moral for the parliament not to elect a Supreme Judicial Council for so many years?” Why didn’t they initiate a procedure? In my opinion, we are witnessing behind the scenes. Apparently there was no prior political agreement. The root of immorality is in the National Assembly,” he pointed out regarding the fact that the SJC’s mandate has expired.
Stankov asked what is the control over the executive power by the parliament.
“We have to get used to the idea that the Constitutional Court is a political body, not a body of judicial power. The relevant authorities are represented in it and political decisions are made in it. This is the second chamber of the parliament,” the former minister of justice said in a controversial statement. In fact, the SC has a quota for the parliament, but also for the president and the community of magistrates.
