The Superior Court of Madrid has decided to leave in six months the sentence of up to five years in prison of a national police officer for attacking and irregularly detaining a man who was also carrying a baby in his arms. The judges maintain that the agent irregularly detained the man but understand that he did not commit a more serious crime of illegal detention because they had had previous confrontations and he acted, they say, convinced that both he and his family were being threatened by the victim.

The events, as elDiario.es revealed, occurred in front of the mixed police station in the Madrid town of Aranjuez in the summer of 2018. The man, who by then already had a record of having threatened another agent with a screwdriver, had reported by telephone to both the Police and the Civil Guard who were heading towards the building to report a police officer. He accused this agent of having “strangled” him during an arrest, an attack of which there is no record.
