The High Court asked the National Highway Authority to immediately close potholes on the national highway. Urgent action is needed in this regard. Justice Devan Ramachandran, through amicus curiae, directed the Kerala division officer of the National Highways Authority. The intervention of the court is in the background of the death of a scooter rider who fell into a big pothole in front of Nedumbasseri Mar Athanasius School the other day. The incident was brought to the attention of the High Court by an amicus curiae appointed to assist the court in cases where the deplorable condition of the roads was requested to be resolved.
Two weeks ago, the court warned that the responsibility of the roads lies with the contractors and engineers and if any more lives are lost on the road, they will have to take responsibility. The court also said that those responsible for paying compensation will be liable. It is in this background that the amicus curia informed the court about the dilapidated condition of the national highway. The state government lawyer also clarified that the state is not in control of the national highway and no action was taken despite constant requests to the national highway authorities to close the potholes. Following this, the High Court issued instructions to the National Highways Authority. The case will be heard on Monday.
Hashim, a native of Manjali Manakkapadi, died in an accident on the national highway near Nedumbasheri at around 10:30 on Friday night. Hashim, who was a cashier at a hotel in Angamaly, was returning home after work when he fell into a two feet deep pit. Many people had fallen in this in the previous days as well.
