Shaïna Hansye will never be 16. In October 2019, his teenage body was found charred at the bottom of an abandoned shed in the allotment gardens of Creil, in the Oise. The autopsy will reveal that she was still breathing when she was set on fire.
Shaïna burned to death at the age of 15, after being stabbed ten times. She was pregnant, and attributed her pregnancy to the man who had just been convicted of her murder. Aged 17 at the time of the events, he was sentenced to eighteen years’ imprisonment by the assize court for minors of Oise, Friday, June 9. The Advocate General had requested the lifting of the minority excuse – which the court rejected – and asked for thirty years in prison.
“Completely crushed” in his glass box, in the words of his lawyer, Elise Arfi, Shaïna’s ex-boyfriend has continued to deny throughout the week of trial held behind closed doors in Beauvais. “The investigation went head-on into a person designated by public outcry as the culprit. But when a person denies with a file that is far from concrete, you have to remain on the reserve, ” believes Elise Arfi, according to whom “no other avenue has been explored” and some “shadow areas” have not been lifted. Not to mention, she adds, the absence of DNA from her client on the knife found in the shed. His colleague, Mr.e Adel Fares, had therefore pleaded acquittal for the young man of today 20 years past.
“His guilt is no longer in dispute”decides the lawyer of the family of Shaïna, Negar Haeri, who unrolls the elements ” goals “ which, according to her, led to a conviction: this injury to the leg, which he presents as eczema but described as a burn by the medical examiner. Or his phone turned off the night of the murder, between 9:36 p.m. and 10:13 p.m., and which was five minutes from the shed when he turned it back on, a few minutes after the start of the fire. “The case is not based on the rumor that designates him, or on simple testimonies,” she insists.
A “continuum of violence”
During the first days of the hearing, some prosecution witnesses recanted or took refuge behind their failing memory, causing the victim’s family to despair. A childhood friend thus claimed to no longer remember the traces of blood, which he had declared to have seen on the accused at the time. Two former fellow prisoners who would have heard him boast of having killed Shaïna because she was a “bitch” or that he would rather kill her than be “the father of a bastard” simply did not come to the hearing, despite the arrest warrants.
