The Supreme Court confirms the criteria of the Provincial Courts in the reviews of sentences carried out after the reform of Organic Law 10/2022

The Plenary of the Criminal Chamber of the Supreme Court agrees to reject the appeals raised by the Prosecutor, who postulated the increase in sentences, with the exception of the accessory penalties of the rights to parental authority, guardianship and curatorship. However, in one of the appeals made by the prosecutor, a dosimetric error by the Court has led to the unanimous correction of the sentence, upwards. The petitions of those convicted in the appeals they presented are also dismissed. Of the 29 appeals analysed, 27 have been unanimously resolved by the Plenary. One has been by majority but without announcing a particular vote, and the other, for which Judge Andrés Palomo was a rapporteur, has caused the change of presentation, which will be assumed by Judge Leopoldo Puente, and which is the only matter that ..
