Beware of the new DGT fines

The regulations have changed this 2023. In the first place, fines that already existed previously have been toughened, and the fines that were non-existent until now and that the DGT has already begun to impose. One of these new sanctions is precisely the possibility of entering or not in the Low Emission Zones that have a population center of more than 50,000 inhabitants. If a vehicle accesses one of these new areas without a label proving its entry into the area, the Administration, in this case the City Council, will penalize with amount of 200 euros.

For this reason, and according to Susana Sagra Alvarez, a lawyer for Pyramid Consulting, “we must bear in mind that the DGT environmental badge must be visible at all times in the vehicle. Although the DGT does not require this, since for this type of complaint, the competent body is the City Council itself and it is these that determine the amount of the fines.

«For example, the Madrid City Council is sanctioning an amount of 200 euros for this type of complaint. For this reason, from Pyramid Consulting, we recommend resorting to this type of fine, since, among others, it is disproportionate”, explains Sagra.

Another of the sanctions that has been created is the one that affects users of Personal Mobility Vehicles (VMP), is that VPM users have the obligation to submit to alcohol and drug tests, being penalized with the same amount cheaper than if they drove another vehicle. And it is that VMP users are obliged, like any other driver, to submit to drug and alcohol controls.

«In case of exceeding the alcohol rates of 500 to 1,000 euros depending on the rate; while in the event that there is a presence of drugs in the driver’s body, the fine is 1,000 euros, “sagra details. «In case of refusing to submit to said tests, it will be denounced as an administrative infraction. If the driver tests positive for alcohol or drugs, the VMP is immobilized, just like the rest of the vehicles”, he adds.

Currently the law stipulates two maximum rates of alcohol at the controls of our vehicle. In general, it is set at a maximum of 0.25 mg/l of expired air and 0.15 mg/l for novice and professional drivers. Now this rule has been added to the 0.0 rate for children under 18 years of age. In the VMP they can only transport one person and at night they are obliged to wear reflective clothing The VMP and other light electrically propelled vehicles are only authorized to transport one person, so the circulation of two people in a vehicle of these characteristics is punishable by a fine of 100 euros.

Another new fine would be, that if we drive at night “We have the obligation to wear a reflective garment to be seen by other drivers. It will be considered negligent driving and therefore punishable when driving at night without lighting or reflective clothing or elements. The corresponding penalty is 200 euros », he concludes.
