Roskomnadzor will collect hosting services into the register

Roskomnadzor (RKN) will be responsible for maintaining the register of hosting providers. The agency will have to formulate rules for maintaining the register, requirements for providers to be included in the register, and also monitor providers’ compliance with these requirements. This follows from three draft government decrees prepared by the Ministry of Digital Development and published on the portal regulation.gov.ru.

“The specified documents will come into force on December 1, 2023. After their adoption and entry into force, RKN will begin to form and maintain a register of hosting providers,” a RKN representative told Vedomosti.

At the end of July 2023, the State Duma adopted changes to the laws “On Information, Information Technologies and Information Protection” and “On Communications,” Vedomosti wrote. The adopted document implies the creation of a new register of hosting providers, registration in which will be mandatory for them. With the creation of the registry, the requirements for the activities of hosting providers are becoming more stringent, says Selectel technical director Kirill Malevanov. They must be registered in Russia, their computing power must be located in Russia, and providers must have the technical capabilities to ensure information protection requirements and install technical means to counter threats.

According to the law, hosting providers will also be required to use the national domain name system, as well as provide access to the FSB and RKN for conducting operational investigative activities. Hosting will be able to provide its services only to persons who have passed the authentication procedure in the manner established by the government.

To be included in the register, providers will have to send a notification to the RKN, which will be reviewed within 10 working days, it follows from the documents. In addition, providers will have to notify the RKN about the start of activities no later than 10 working days before its start through their personal account on the regulator’s website, one of the acts says. Existing providers must report this no later than December 15, 2023, the documents state.

Hosting providers that are not included in the register will not be able to operate, notes the founder and CEO of the hosting provider RUVDS Nikita Tsaplin. “That is, if previously hosting could generally even ignore the requirements from government agencies and they couldn’t really do anything to it, now such hosting can be excluded from the register and thus prohibited from operating,” he explained.

The expert believes that the creation of a registry will be a plus for clients, since the hoster will be required to meet information security requirements, and the number of attacks on the network, including to and from the hoster, should decrease. But if the hoster does not get into the register, then its client “will have to move” so that its resource itself complies with the requirements of the Russian Federation, Tsaplin added.

“The introduced requirements cannot be called unaffordable. In our opinion, most large providers will be able to comply with them. The most difficult thing to cope with will be small providers who do not have financial resources and expertise, as well as those whose field of activity lies in the gray borders,” says Malevanov.

The innovation will create additional guarantees for clients who are in search of a reliable hosting service provider that meets the legal requirements, Malevanov added. But, according to him, “clients should take into account that the activities of providers who are not included in the RKN register may become illegal.”
