The termination of the Artistic Director of the State Ballet School Berlin, Gregor Seyffert, remains ineffective. According to information on Friday, the Berlin-Brandenburg State Labor Court confirmed a corresponding decision by the lower court. An appeal to the Federal Labor Court was not permitted. The Senate is finally inferior in the dispute.

The defendant country as an employer did not terminate the contract in due time, it said. According to the court, the ordinary notice of termination declared in the alternative is also ineffective because ordinary termination is excluded according to the relevant provisions of the collective agreement. Since the termination is ineffective, the plaintiff has a right to continued employment.

The labor court had already declared the resignation of the head of the ballet school Ralf Stabel to be ineffective, but rejected an action for continued employment.

The headmaster and artistic director of the ballet school were released from duty in the course of investigations after initially anonymous allegations about the situation at the school. In statements they spoke of “slander, false allegations and accusations” that were circulating. The management posts were advertised again.

The climate and methods at the ballet school have been heavily criticized by experts in two interim reports. One clearing house assumes that “the child’s well-being can be identified through physical and psychological abuse, emotional neglect, neglect of health care and the duty of care and supervision”.

There were repeated doubts and massive criticism of the way the Senate dealt with the allegations and, above all, of the action taken against the two recognized artists.
