Podemos insists that Judge Manuel García Castellón be investigated for having transgressed in the “secret” and “prospective” case that he instructed for almost nine months to try to prove non-existent illegal financing. The Supreme Court rejected the party’s complaint and the party has filed an appeal, which must be resolved by the same court, in which it accuses García Castellón and his supporting judge, Joaquín Gadea, of acting against the political party and its founders with “ fully aware” of the injustice they were committing.
To attribute the crime of prevarication, it is necessary that the “unjust resolution” be adopted by a public official “knowing” that it is so. For Podemos, the list of the decisions adopted by García Castellón and Gadea in the case already allows us to conclude that both acted with “full awareness of the illegality and departure from the correct application of the law” and that they did so “with the objective of harming to a political party whose ideology, apparently, is not to the taste of the magistrates.”
