Spaniards who reside abroad and find themselves in a precarious situation can obtain financial support from the State to cover their basic needs. The aid is called a need-based benefit, and it is one of those offered by the General Directorate of Migrations to citizens living in other countries, but also to those who decide to return to Spain.

This economic support aims to guarantee “a minimum of subsistence” for Spaniards over 65 or disabled, who lack resources and also reside in countries “where public social protection systems do not cover their basic needs.”

The benefit due to need includes the following actions: financial benefit for old age; due to absolute incapacity for all types of work, and health care.

Beneficiaries

Spaniards of origin born in national territory who for various reasons left Spain to reside in a country “where the social protection system is insufficient and justifies” the aid may be eligible for the benefit. Also those who were born abroad, reside in one of those countries and prove that they have lived in Spain for at least 10 years before submitting the application for the benefit.

Requirements

Having reached 65 years of age (economic benefit for old age or disability) and being over 16 and under 75 years of age in the case of the permanently disabled in their absolute degree.

Nor can they belong to “orders or institutes” that by their rules must provide assistance to their members, lack sufficient income, do not own movable or immovable property -except the habitual residence- whose patrimonial value exceeds the calculation base from which the amount of the benefit is determined.

The amount of the old-age benefit, according to the regulations (royal decree 8/2008, of January 11), will depend on the funds that are consigned annually in the budget item of the Ministry of Inclusion, Social Security and Migrations, “according to with the economic and social protection indicators of each country of residence.

For these purposes, per capita income, the Minimum Interprofessional Salary (SMI), the average salary of a worker employed by others, and the minimum Social Security pension will be taken into account.

The General Directorate of Emigration will annually set the calculation base corresponding to each country in euros and local currency. The amount will be the result of subtracting from said base the annual income or income available to the beneficiary, if applicable.

In any case, the maximum amount “will not exceed that established in Spain at any time for the non-contributory modality of Social Security retirement pensions.” And the minimum will be equal to 25% of the amount shown by the economic and social protection indicators of each country of residence.

Beneficiaries of this benefit will also be entitled to health coverage if that of their country of residence does not provide it or is insufficient.
