Devikulam election case: UDF candidate Kumar filed a stay petition in the Supreme Court

New Delhi: UDF candidate D Kumar has filed a stay petition in the Supreme Court in the Devikulam election case. In A Raja’s appeal against the High Court order canceling his membership of the legislature, Kumar wants the order not to be passed without hearing his side. The interlocutory petition was filed through lawyer Aljo Joseph.

The High Court has granted an interim stay on the verdict canceling the election victory of CPM member A Raja. A stay of ten days has been granted for filing an appeal in the Supreme Court. The court verdict has clarified that Raja does not have the right to be an MLA.

It is indicated that Raja will appeal to the Supreme Court soon against the High Court’s decision canceling his membership of the legislature. As part of this, the CPM leadership has started consultations with senior lawyers. The CPM state secretariat had decided to file an appeal in the Supreme Court against the High Court verdict.

The High Court canceled the election on the grounds that A Raja does not belong to Hindu Scheduled Caste and Raja, who is a Christian, is not eligible to contest the reserved seat. The court passed the verdict on a petition filed by UDF candidate D Kumar.
